Doublestack is made by Nightjar Labs LLC (“we”, “us”). Installing or using the app means you accept these terms. If you do not accept them, do not use the app.
Who can use it
You must be 13 or older. The app is not directed at children and is not enrolled in Google Play’s Designed for Families programme or Apple’s Kids category.
The app is provided as-is
Doublestack is provided “as-is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will be uninterrupted, error-free or that any defect will be corrected. You use it at your own risk.
What you may not do
- Reverse-engineer, decompile or disassemble the app, or try to extract its source code, except to the extent that law expressly permits it despite this restriction.
- Copy, sell, sublicense, rent or redistribute the app or any part of it.
- Modify the app, or use any tool that alters gameplay, scores or purchases.
- Use the app to break the law or to harm anyone.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use one copy of the app on devices you own or control, for your own non-commercial use. We keep every right not expressly granted here.
Purchases and ads
Doublestack Pro is a one-time purchase that removes the ads shown between runs, unlocks every palette and gives you two continues per run instead of one. It is sold and billed by the app store you bought it from, not by us. We never see your payment details. Refunds are handled entirely by that store under its own policy, so ask them, not us.
The app shows ads and may offer optional rewarded videos. We do not control what an ad contains and are not responsible for anything an advertiser says or sells.
Anything you unlock, score or earn in the app is a feature of the app. It has no cash value, is not property, and cannot be transferred or exchanged.
Our intellectual property
The Doublestack name, logo, artwork, code and design belong to Nightjar Labs LLC and are protected by copyright and trade mark law. These terms give you no right to use them.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from your use of the app. Our total liability for any claim relating to the app is capped at the greater of the amount you paid us for it in the twelve months before the claim, or five US dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the above applies to you only as far as that jurisdiction allows, and nothing here removes a right you have that cannot be waived.
Ending this
You can end these terms at any time by deleting the app. We can suspend or end your access if you break these terms. The sections on intellectual property, liability and disputes survive.
The app stores
These terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the app or for supporting it, and neither has any warranty obligation to you. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of these terms or out of your use of the app will be brought exclusively in the state or federal courts sitting in New York, and you and we each consent to the jurisdiction of those courts. If you are a consumer, nothing here takes away the protection of any mandatory law of the country you live in.
Changes to these terms
We may update these terms. The new version is posted here and the “Last updated” date is revised. If a change is material, the app asks you to accept it before you carry on playing. Continuing to use the app after that means you accept the change.
