This policy is for people in Washington, Nevada and Connecticut, whose laws give consumer health data its own protections. It covers the Opson app made by Nightjar Labs LLC. It takes effect on October 27, 2026. Our Privacy Policy covers everything else.
The consumer health data we collect, and why
| What | Why we collect it and how we use it |
|---|---|
| Your food log: foods, amounts, nutrition values, meal times, water and fasts | To show your log, totals and trends, and to sync them between your phones |
| Weigh-ins | To show them and your trend, if you add them |
| How meals and days felt: hunger, fullness, mood, notes and check-ins | To show them back to you alongside your log |
| Your setup answers, including whether numbers or tracking have been hard for you before | To choose gentler starting settings for you; nothing else |
| Targets and the numbers you choose to see | To apply your settings everywhere in the app |
| What you search for and type to find foods | To find matching foods. Searches are kept without any link to you; typed meals are not kept |
| Meal photos, if you use photo estimates | To list the foods in the photo. Not kept |
| Energy and workouts from Apple Health or Health Connect, if you connect them | To show them in the app. Read on your phone only; never sent to us |
Totals, trends and patterns the app works out from these are consumer health data too, and we use them the same way.
Where it comes from
From you, when you use the app, and from Apple Health or Health Connect on your phone if you give the app permission. We don’t buy or receive consumer health data from anyone else.
Who we share it with
We share consumer health data only with the processors that run the app for us, under contracts that let them use it only for that:
- Hosting and storage: Fly.io and Supabase, which run our server and store your synced log.
- Photo analysis: Anthropic, only for a photo estimate you ask for.
- Crash reporting: Sentry. Crash reports are built to leave out your log, but a report about a failed food search can include the words searched.
We have no affiliates that receive it. We don’t sell consumer health data, and we don’t share it with anyone for their own purposes. We don’t use geofencing.
Consent
We collect consumer health data only as needed to provide the features you ask for. If we ever want to collect or share it for another purpose, we will ask for your consent first, separately, and you can withdraw it at any time.
Your rights, and how to use them
You can:
- confirm whether we collect, share or sell your consumer health data, and get a copy of it, with a list of every third party and affiliate we’ve shared it with and how to contact them;
- delete it, which we pass on to our processors;
- withdraw any consent you’ve given;
- appeal if we turn down a request.
Use More → Support and sharing in the app to export or delete your data, or email contact@nightjarlabs.llc for anything else. We answer within 45 days. If we need longer, we’ll tell you within those 45 days, and take no more than 45 more. Requests are free up to twice a year. Because most Opson accounts have no name or email attached, we may ask you for details from the app so we can find yours.
Deleting your account removes your data from our database straight away and from backups within 30 days.
To appeal, reply to our answer and say you’re appealing. We decide within 45 days and explain our decision. If you disagree with it, you can contact the Washington Attorney General at atg.wa.gov, the Nevada Attorney General at ag.nv.gov, or the Connecticut Attorney General at portal.ct.gov/ag.
Changes
If this policy changes, the new version is posted here with a new date. If a change is material, we will tell you in the app before it applies to you, and ask for consent where the law requires it.
